1. Introduction

Welcome to Ciaran Barry Coaching ("Company," "we," "us," or "our"). By engaging with our coaching services, you ("Client") agree to abide by these Terms of Service ("Terms"), which govern your participation in our coaching programs and define our mutual obligations. Ciaran Barry Coaching is a registered entity in the Republic of Ireland (Reg. No 726846). These Terms constitute a legally binding agreement between you and Ciaran Barry Coaching.

2. Description of Coaching Services

Coaching is a professional partnership between the Coach and the Client, designed to facilitate personal and professional growth. The Coach will provide structured guidance, support, and accountability to assist the Client in achieving self-determined goals. However, coaching is not a substitute for therapy, counseling, or any form of medical or psychological treatment. The Client acknowledges that they are responsible for their own progress, actions, and outcomes.

By participating in coaching sessions, the Client agrees to actively engage in the process, prepare for each session, and take responsibility for implementing strategies discussed with the Coach. The Client also acknowledges that the Coach does not guarantee specific results or outcomes.

3. Client Obligations

To ensure an effective coaching relationship, the Client agrees to:

  • Engage in all coaching sessions with a committed and open mindset.
  • Provide honest, accurate, and complete information to facilitate meaningful discussions.
  • Accept feedback and be willing to explore new perspectives.
  • Allocate time between sessions to implement agreed-upon strategies and action points.
  • Refrain from using coaching as a substitute for medical, financial, legal, or psychological advice.
  • Respect the confidentiality and intellectual property of Ciaran Barry Coaching.

4. Confidentiality

Ciaran Barry Coaching is committed to maintaining the confidentiality of all client interactions. Information shared during coaching sessions will not be disclosed to third parties unless required by law or explicitly authorized by the Client. The Client acknowledges that coaching does not constitute a legally privileged relationship, such as those existing between a client and a lawyer or therapist.

Ciaran Barry Coaching operates in compliance with the General Data Protection Regulation (GDPR) of the European Union and ensures the secure handling of personal data. Any disclosure of personal information will be conducted with the Client’s express written consent unless legally required otherwise.

5. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Coach provides coaching services on an "as is" basis and makes no express or implied warranties regarding results or outcomes.
  • The Coach shall not be liable for any direct, indirect, incidental, or consequential damages, including but not limited to financial losses, reputational damage, or personal distress resulting from the Client’s decisions or actions.
  • The total liability of Ciaran Barry Coaching under these Terms shall not exceed the amount paid by the Client for the coaching services.

6. Use of Client Information for Professional Certification

Ciaran Barry Coaching may be required to disclose limited client information (such as name and contact details) to accrediting bodies such as the International Coach Federation (ICF) for verification purposes. No confidential session details or notes will be shared. By engaging in coaching services, the Client consents to the disclosure of such limited information solely for certification purposes.

7. Records Retention

Ciaran Barry Coaching will maintain client records, including session notes and action plans, for a period of twelve (12) months following the conclusion of the coaching engagement. After this period, records will be permanently deleted unless the Client requests their retention in writing. Records are handled in compliance with applicable data protection laws.

8. Fees and Payment Terms

The details of the coaching programme, including pricing and duration, are provided in the Client's invoice. Payment must be made in full prior to the commencement of services. If payment is delayed, Ciaran Barry Coaching reserves the right to suspend coaching services until payment is received.

8.1 Payment in Installment

Ciaran Barry Coaching offers the option to pay in three installments through Klarna, a third-party payment provider. By selecting Klarna Pay at checkout, you acknowledge and agree to the following:

  • Klarna Pay is an external service and is subject to Klarna’s own terms and conditions, which you must agree to at the time of purchase.
  • Ciaran Barry Coaching is not responsible for the administration or management of your payment plan with Klarna.
  • Late or missed payments may incur additional fees as outlined in Klarna’s policies.
  • For full details, please refer to Klarna’s Terms & Conditions and Privacy Policy available at www.klarna.com.

9. Cancellation and Rescheduling Policy

Clients may cancel or reschedule a coaching session by providing a minimum of twenty-four (24) hours’ notice. Cancellations made with less than twenty-four (24) hours’ notice may be subject to a cancellation fee. Repeated cancellations without proper notice may result in restrictions on future bookings.

10. Termination and Refund Policy

10.1 Termination by the Client

The Client may terminate their participation in a coaching programme at any time by providing fourteen (14) days' written notice. However, payments made for services rendered are non-refundable unless otherwise specified under our Money Back Guarantee.

10.2 Money Back Guarantee

Clients enrolled in the Limitless Life Programme or Career Launchpad Programme may request a refund of programme fee under the following conditions. A refund request must be submitted in writing within twenty-one (21) calendar days from the date of enrolment, which is defined as the date on which full payment of the programme fee is received by Ciaran Barry Coaching, or within twenty-four (24) hours following the completion of the first coaching session, whichever occurs earlier. To remain eligible for a refund, the Client must complete their first coaching session within three (3) weeks of the date of enrolment. Failure to do so will render the programme non-refundable. If the first coaching session has already been delivered at the time the refund request is made, the cost of that session will be deducted from the total refund amount. The standard session rate applicable at the time of enrolment will be used to determine this deduction. All refund requests must be submitted in writing and must include a clear explanation of the reasons for dissatisfaction. Requests that do not meet these requirements may be declined. Approved refunds will be processed using the original method of payment within a reasonable timeframe. Refunds are not available for individual coaching sessions or single services such as the CV Mastery Session or Interview Strategy Session.

10.3 Gifted Programmes

If a coaching programme has been purchased as a gift, refund requests must be submitted by the original purchaser. No refund will be granted once the first coaching session has been completed. The first session must be scheduled and completed within four (4) weeks of purchase, or the programme will be deemed non-refundable.

11. Intellectual Property Rights

All content, materials, and proprietary methods used by Ciaran Barry Coaching remain the intellectual property of Ciaran Barry Coaching. The Client may not reproduce, distribute, or share any coaching materials without prior written consent.

12. Amendments to Terms

Ciaran Barry Coaching reserves the right to update these Terms at any time. Clients will be notified of material changes affecting their coaching relationship.
